Important: VidSparks Token Packs are one-time purchases and do not renew. Users may stop using the Service and close an Account, but closure does not automatically refund purchased Tokens. Unused Tokens and digital entitlements are extinguished on closure unless a mandatory legal remedy applies. Personal-data deletion is handled separately under the Privacy Policy.

1. Scope and interpretation

1.1 This Policy explains how a user may cancel use, close an Account, end access to generation features and understand the consequences for Tokens, Outputs, payments and data. Because VidSparks does not create a subscription through ordinary Token Pack purchases, there is no recurring plan to cancel.

1.2 Cancellation means voluntary ending of Account access or withdrawal from a transaction where a statutory right remains available. Closure means disabling the Account. Termination means VidSparks ends or restricts access. Deletion means removal of personal data where the Privacy Policy and applicable law permit.

2. Nature of the Service and purchases

2.1 The Service provides account-based artificial intelligence video generation funded by one-time fixed or flexible Token Packs. Tokens are digital contractual units used only within the Service and are not money, stored value or a refundable balance merely because they remain unused.

2.2 A purchase is completed separately each time the user authorises checkout. No automatic renewal, recurring debit or minimum term is created. Stopping use does not require a future billing mandate to be revoked, but the user should still resolve pending payments, refunds and chargebacks before closure.

3. Ways a user may cancel or close an Account

3.1 A user may request closure by emailing info@vidsparks.com from the registered Account address. The request should state that Account closure is required and identify any open payment, refund, rights or safety issue that must remain accessible during processing.

3.2 Where an in-Account closure control is available, the user may use it after reviewing the consequences. We may require re-authentication or identity confirmation. A representative must provide authority. We do not close an Account solely on an unverified message from an unrelated address.

3.3 A user can also stop using the Service without immediate closure. Inactivity alone does not create new charges because Token Packs do not renew. However, keeping an Account open means credentials and stored content must continue to be protected.

4. Effective time of a user cancellation

4.1 A closure request becomes effective when we verify the request and disable ordinary access. We aim to acknowledge the request within two business days and complete straightforward closure within five business days, subject to security, payment, legal-hold or safeguarding issues.

4.2 A Generation Request already processing may complete and consume the displayed Tokens because computational performance began before closure. We may prevent new requests as soon as the closure instruction is verified. A pending Token Pack payment may be completed, reversed or reviewed according to its PSP status.

5. Consequences of voluntary closure

5.1 The user loses access to the Account, Token balance, saved settings and Outputs stored only through the Service. The user should download needed Outputs and receipts before requesting closure. We do not guarantee recovery of material after the closure workflow is completed.

5.2 Unused purchased and promotional Tokens are extinguished and cannot be transferred, sold, gifted, cashed out or moved to a new Account. Closure does not cancel obligations or liabilities that arose before it, including a valid payment, rights claim, infringement complaint or misuse investigation.

5.3 Provisions concerning intellectual property, payment, refunds, liability, disputes, privacy, evidence and governing law continue where their nature requires survival. The user remains responsible for Outputs already published or supplied to third parties.

6. No automatic refund on cancellation

6.1 Voluntary Account closure is not itself a refund event. Successfully delivered Token Packs are not converted into cash because the user chooses to stop using the Service. A refund requires an eligible basis under the Refund Policy or a mandatory statutory right.

6.2 A user should submit a qualifying refund request before closure where possible so transaction and generation evidence can be reviewed while the Account is accessible. If closure occurs first, we may still investigate a valid claim using retained records, but identity verification and evidence gathering can take longer.

6.3 If a refund is approved, the associated Tokens are removed and the funds return to the original payment method. Closure does not produce an additional refund or restoration. Promotional Tokens and goodwill credits have no cash value.

7. Company-initiated suspension, restriction or termination

7.1 VidSparks may suspend or terminate access for serious or repeated breach, payment fraud, chargeback abuse, unlawful or harmful content, compromised credentials, sanctions, attacks on the Service, unauthorised resale, impersonation or failure to cooperate with a proportionate security investigation.

7.2 Measures may begin with a feature block, content removal, Token freeze or temporary suspension. We may act immediately where delay creates risk to a person, payment partner, rights holder or system. Where safe and appropriate, we provide the principal reason and an opportunity to submit relevant information.

7.3 Termination for user breach does not automatically create a refund. Unused Tokens are extinguished, subject to mandatory rights and any portion that must be refunded because the termination was not caused by the user or because continued performance became impossible for reasons within our control.

8. Effect of fraud, abuse or disputes on cancellation

8.1 A closure request does not erase evidence or stop a fraud, chargeback, rights or safety investigation. We may restrict access, preserve relevant records and communicate with the PSP, issuer, regulator or rights holder where lawful. This prevents closure from being used to evade accountability or obtain duplicate value.

8.2 Tokens linked to a disputed payment may be frozen or reversed. If the user closes the Account during the dispute, the final payment outcome still determines the ledger and any monetary remedy. A chargeback decided for the cardholder does not entitle the user to retain the related Tokens or Outputs in the Account.

9. Treatment of Tokens, Outputs and digital entitlements

9.1 On closure or termination, all unused Tokens, promotional credits, saved generation rights and Account-only entitlements are extinguished. They are non-transferable and non-cashable. No successor Account acquires them unless VidSparks expressly corrects a verified duplicate or wrong-Account error before closure.

9.2 Outputs downloaded before closure may remain in the user possession, subject to third-party rights, the Terms & Conditions and any model-provider restriction disclosed for the relevant purchase. Access to copies stored in the Account ends, and temporary storage may be deleted according to the Privacy Policy.

9.3 Where a monetary refund is granted, the corresponding Tokens are reversed or clawed back. We may disable Account-hosted Outputs generated with refunded Tokens where technically appropriate. This prevents the user receiving both the refunded price and the same digital value.

10. Guest access, dormancy and inactivity

10.1 Ordinary purchases require an Account so Tokens can be delivered and used. If limited guest access is offered for browsing or a trial, it does not create a transferable entitlement. A guest should register only with accurate information and may not create repeated identities to obtain promotional value.

10.2 Inactivity does not generate recurring charges. We may classify an Account as dormant after 24 months without login or transaction and send notice before closure where contact remains valid. Security, storage and legal obligations may justify closure of long-inactive Accounts.

10.3 A dormant Account may require re-authentication before use. If it is closed after notice, unused Tokens are extinguished unless law requires another treatment. Users should not treat the Account as permanent storage and should maintain independent copies of important Outputs.

11. Deletion of personal data versus closure of access

11.1 Closing an Account ends access but does not necessarily delete every record immediately. Transaction, tax, fraud, dispute, security and legal-claim data may be retained for the periods and purposes stated in the Privacy Policy. Operational Inputs and Outputs are normally deleted on the stated storage cycle.

11.2 A privacy erasure request is assessed under data protection law and can be combined with closure, but it does not reverse a payment, create a refund or remove records that must be retained. Conversely, a refund request does not automatically erase the Account or personal data.

11.3 We may ask the user to clarify whether they seek closure, erasure, refund, unsubscribe or all applicable actions. Clarification ensures that one request is not mistakenly treated as another and that non-excludable rights are handled under the correct legal test.

12. Service retirement, major changes and sunset

12.1 We may retire a model, feature or the Service for legal, provider, security or commercial reasons. Where a change materially prevents use of purchased, unused Tokens, we will provide reasonable notice where practicable and consider an equivalent route, conversion, continued access period or remedy required by law.

12.2 A planned full sunset will normally include instructions for downloading Outputs and submitting unresolved claims. Users should act within the notice period. We will not use a service retirement to avoid accrued consumer remedies or retain payment for digital value that cannot be supplied.

13. Cooling-off and mandatory consumer rights

13.1 A UK consumer may have a 14-day right to cancel a distance contract. For digital content supplied immediately, that right may be lost when the consumer expressly requests immediate supply and acknowledges the consequence before supply begins. Checkout may capture that request and acknowledgement.

13.2 The immediate-supply rule does not remove remedies for defective, misdescribed or non-delivered digital content. Consumers in other jurisdictions retain mandatory local protections. This Policy is interpreted to preserve those rights and to provide any remedy that cannot lawfully be excluded.

14. Reopening, restoration and new Accounts

14.1 A voluntarily closed Account may be restored only if data and access remain technically available, identity is verified and no security or legal reason prevents restoration. Restoration is not guaranteed and does not revive extinguished Tokens unless a verified processing error caused the balance to be removed incorrectly.

14.2 A person whose Account was terminated for breach may not create a new Account to bypass enforcement. We may link Accounts using proportionate identity, payment, device and security information. An appeal should be made through support rather than through a new identity.

15. Communications and support

15.1 Closure and cancellation requests should be sent to info@vidsparks.com. We use the registered Account email for confirmation and may send a final notice when access ends. Users should keep contact information current until the process and any open claim are complete.

15.2 We acknowledge ordinary requests within two business days and aim to complete verified closure within five business days. A security, payment or legal issue can require additional time. We will explain the status where continued restriction or evidence preservation is necessary.

16. Changes

16.1 We may update this Policy for legal, security, product or operational reasons. The current version and effective date are published on the website. A change does not retrospectively impose recurring billing, remove an accrued right or alter the outcome of a completed closure without lawful basis.

16.2 Material changes affecting future closure consequences will be notified through the website, Account or email where reasonably practicable. A user who does not accept a future-use change may stop using the Service and request closure under the then-current process.

17. Governing law and contact

17.1 This Policy is governed by the law of England and Wales, while preserving mandatory consumer protection in the user country of habitual residence. Courts available under applicable consumer law remain available, and no provision requires a consumer to waive a non-excludable remedy.
