Important: VidSparks may be used only for lawful, authorised and non-deceptive artificial intelligence video creation. Prohibited uses include payment fraud, account trading, safety-filter circumvention, non-consensual intimate material, child sexual abuse material, harmful impersonation, scams, rights infringement, malware and attempts to disrupt or reverse engineer the Service.

1. Scope and relationship with other documents

1.1 This Policy governs conduct on the website, Account, checkout, Token ledger, generation tools, uploads, prompts, Outputs, support channels and any integration made available by VidSparks. It applies to individual users, organisation administrators, authorised collaborators and anyone acting through an Account.

1.2 The Policy forms part of the Terms & Conditions. Payment misuse is also addressed by the Payment and Refund Policies; closure and enforcement outcomes are addressed by the Cancellation Policy; personal data is handled under the Privacy Policy. A use can breach more than one document and may trigger more than one response.

2. Core principle of permitted use

2.1 Use VidSparks for lawful creative, educational, promotional, entertainment, prototyping and production purposes where you hold the necessary rights and permissions. Your use must be honest about synthetic content where context requires disclosure and must not create an unreasonable risk of deception, exploitation, discrimination, violence or rights infringement.

2.2 You are responsible for Inputs, instructions, intended audience, publication and downstream use. The fact that a request passes an automated filter does not mean the use is lawful, ethical, accurate or authorised. Review every Output and apply human judgement before sharing or relying on it.

2.3 Where local law, a platform, professional code or contract imposes stricter requirements, follow the stricter rule. VidSparks permission does not override the rights of a depicted person, copyright owner, performer, trade mark owner, employer, client or regulator.

3. Account integrity and identity

3.1 Provide accurate registration information, protect credentials and use only Accounts you are authorised to control. Do not share credentials publicly, sell or rent access, impersonate another person, create Accounts under false identities or use another user Account after permission ends.

3.2 Multiple Accounts may not be used to obtain repeated promotions, avoid limits, conceal sanctions or bypass suspension. Organisation administrators must manage access and remove former personnel. A user who suspects compromise must change credentials and notify support promptly.

3.3 Do not use automated registration, credential stuffing, stolen sessions, phishing or social engineering. We may require verification, link related Accounts and restrict suspicious access using proportionate device, payment, identity and network information.

4. Prohibited payment and checkout behaviour

4.1 Do not use stolen or unauthorised payment instruments, false billing information, manipulated location, split transactions to evade controls, compromised wallets, refund fraud or a chargeback planned after consuming Tokens. Do not buy or sell Tokens outside the approved checkout.

4.2 Do not exploit duplicate-credit, pricing, currency, coupon or ledger errors. If an error gives unexpected value, stop using it and report it. Deliberate use after discovery may result in reversal, suspension, termination, dispute evidence and referral where lawful.

4.3 A genuine billing dispute is permitted and does not breach this Policy. Users should provide accurate information and avoid duplicate recovery through both refund and chargeback. False fraud claims or use of disputed value after knowing the payment will be reversed are prohibited.

5. Prohibited generation and fair-use abuse

5.1 Do not submit prohibited content repeatedly, alter wording solely to bypass safety controls, coordinate high-volume abuse, use generated variants to test moderation limits, or consume disproportionate capacity in a way designed to degrade access for others.

5.2 Do not use bots, scripts or parallel sessions beyond an expressly permitted interface, circumvent Token costs, duplicate requests through race conditions, manipulate queue priority or exploit provider retries. Reasonable ordinary use, accessibility tools and authorised integrations remain permitted.

5.3 Do not represent a test, preview, draft or probabilistic Output as verified evidence without independent review. Generated material must not be used to fabricate proof, academic results, product performance, testimonials, identity documents or compliance records.

6. Prohibited technical interference

6.1 Do not probe, scan or test systems without written authorisation; introduce malware; launch denial-of-service activity; intercept traffic; bypass authentication; scrape at harmful scale; access another user data; reverse engineer protected components; or seek model weights, system prompts, secrets or security keys.

6.2 Security research requires prior written scope and safe-harbour terms. A good-faith accidental discovery should be reported privately with reproduction steps and should not be exploited, published with sensitive details, used to access data or conditioned on payment.

6.3 Do not remove watermarks, provenance data, safety labels or technical controls where removal would mislead, violate law or enable abuse. Ordinary editing of an Output is permitted where rights are held and the result is not falsely represented as authentic evidence.

7. Content, conduct and communications standards

7.1 Do not generate, upload, request, publish or facilitate child sexual abuse material, sexualised content involving minors, non-consensual intimate imagery, sexual violence, trafficking, targeted harassment, credible threats, doxxing, hateful dehumanisation, extremist recruitment, instructions for serious wrongdoing or content that unlawfully glorifies terrorism.

7.2 Do not create deceptive impersonation, voice or likeness manipulation intended to defraud, extort, influence a protected decision, mislead voters, fabricate a public emergency, damage reputation or obtain access. Authorised parody, satire, education and artistic work must be clearly contextualised where a reasonable viewer could otherwise be materially misled.

7.3 Do not use support channels for threats, spam, abusive language, phishing, malicious attachments or repeated bad-faith demands. Criticism, complaints and rights assertions are permitted when communicated in a manner that allows the issue to be investigated safely.

8. Intellectual property and unauthorised commercial exploitation

8.1 Only upload or reference material you own, license or are otherwise authorised to use. Do not reproduce protected films, music, characters, logos, scripts, photographs, voices or performances in a manner that infringes copyright, trade mark, moral, publicity, confidentiality or trade-secret rights.

8.2 Do not use VidSparks branding, interface or model access to imply endorsement, certification or partnership. Do not resell access, Token Packs or Account credentials, operate an unauthorised generation bureau through shared logins, or package the Service as your own software without written permission.

8.3 Commercial use of an Output remains subject to rights clearance and any pack-specific terms. The user must assess advertising claims, endorsements, talent releases, music licences and platform rules. VidSparks does not grant rights held by a third party merely because a similar Output can be generated.

9. Account trading, transfers and Token misuse

9.1 Accounts, Tokens and digital entitlements are non-transferable. Do not sell, buy, rent, gift, trade, pledge or broker them, or advertise a secondary market. A purported transfer is void and may expose both Accounts to restriction or termination.

9.2 Do not exploit duplication, rollback, refund or synchronisation errors to create extra Tokens. Do not use chargeback as a method to retain both generated value and payment. Do not create multiple Accounts for introductory offers or transfer Outputs to disguise the source of abusive generation.

9.3 A legitimate organisation may change authorised administrators through support after verification. That controlled change is not Account trading. A merger or business transfer requires written coordination so payment, data and rights obligations remain traceable.

10. Children, age and protective restrictions

10.1 Users must be at least 18. The Service must not be used to target children with exploitative, sexual, manipulative or unsafe content, or to simulate a child in a sexualised or abusive context. Any child depiction must have a lawful, appropriate purpose and required authority.

10.2 Do not use a child image, voice or personal data for profiling, commercial endorsement, deepfake impersonation or sensitive inference without a valid legal basis and suitable safeguards. We may apply stricter moderation, remove content and report suspected child exploitation to competent bodies where required.

11. Reporting, investigations and cooperation

11.1 Report suspected abuse, infringement, harmful synthetic media, account compromise or payment fraud to info@vidsparks.com. Identify the relevant Account, Output or URL, explain the concern and provide lawful supporting evidence. Do not redistribute harmful content more widely than necessary to report it.

11.2 We may preserve logs, Inputs, Outputs, device and payment records; request information; temporarily restrict access; consult providers; and disclose relevant data to an affected person, rights holder, PSP, regulator or law-enforcement body where necessary and lawful. Investigations are handled proportionately and confidentially where possible.

11.3 Users must not destroy evidence, retaliate against a reporter, obstruct a lawful investigation or submit knowingly false notices. A user may explain context, provide permissions and contest a decision. Cooperation does not require self-incrimination beyond applicable law or waiver of statutory rights.

12. Enforcement measures

12.1 Depending on severity, intent, history and risk, we may warn, reject a request, remove or disable content, restore or withhold Tokens, limit features, require verification, block a device or payment method, suspend an Account, terminate access, preserve evidence or report conduct.

12.2 Immediate action may be taken for child exploitation, non-consensual intimate material, credible threats, fraud, compromised credentials, system attacks or other urgent harm. Less serious first-time issues may receive guidance or a narrower restriction where that can safely correct the conduct.

12.3 Unused Tokens are extinguished on termination unless a mandatory remedy applies. Enforcement does not automatically create a refund. Where the user believes a material factual error occurred, they may appeal through support with relevant evidence. We may maintain a restriction while risk remains unresolved.

13. Relationship to refunds, cancellation and data requests

13.1 A request blocked for prohibited content does not normally qualify for a refund or Token restoration where processing or safety review was performed and the rule was reasonably disclosed. A verified technical failure remains eligible for review even if unrelated content concerns also exist.

13.2 A user may close an Account, but closure does not erase evidence or stop a payment, safety or rights investigation. A privacy request is assessed under data protection law and does not require deletion of records needed for fraud prevention, legal claims or protection of others.

13.3 Good-faith complaints, chargebacks and privacy requests are not prohibited. Abuse consists of false information, threats, duplicate recovery, concealment or use of rights processes to facilitate fraud or evade lawful restrictions.

14. Amendments and version control

14.1 We may update this Policy to address new models, abuse patterns, provider requirements, law or safety standards. The current version and effective date are published on the website. A material new restriction will be applied prospectively where fairness and law require notice.

14.2 Urgent safety controls may be introduced immediately where necessary to prevent serious harm. An update does not retrospectively make previously lawful conduct a breach, but ongoing or future use must comply with the current rules once effective.

Include the relevant Account or content reference, the rule concerned and enough detail for review. Do not send passwords, full card data or unnecessary copies of illegal or highly sensitive material.

15.2 We aim to acknowledge complete reports within two business days. Urgent threats or child-safety matters should also be reported to the appropriate emergency or law-enforcement service. Our support route does not replace emergency assistance or a statutory reporting channel.

15.3 This Policy is governed by the laws of England and Wales. It does not exclude mandatory consumer, privacy, free-expression, reporting or procedural rights that apply under another competent jurisdiction.

– Creating a realistic video of a fictional chief executive announcing a fake investment opportunity and directing viewers to a payment page.

– Uploading a private person photograph to create sexualised footage without that person consent.

– Using repeated Accounts and payment instruments to collect introductory Tokens, then consolidating the generated files elsewhere.

– Submitting hundreds of slightly altered prompts to discover wording that bypasses a safety block for violent extremist recruitment.

– Generating a fabricated news clip presented as authentic evidence of an event that did not occur.

– Using an employer Account after access authority ended or selling the credentials to another creator.

– Consuming a full Token Pack, opening a chargeback as fraud and continuing to distribute the Outputs.

– Uploading a protected film scene, performer voice and brand assets for a commercial advertisement without the necessary licences.

Expectations. User Good-Faith Expectations

– Use accurate Account and payment information and keep credentials secure.

– Confirm that you have rights and permissions for every Input, depicted person, voice, logo, script and music element.

– Review Outputs for accuracy, harmful bias, disclosure needs and platform compliance before publication.

– Stop and report unexpected Token, pricing or access errors rather than exploiting them.

– Respond honestly to proportionate verification or rights enquiries and preserve relevant references.

– Use complaint, refund and privacy routes for their intended purpose without threats or duplicate recovery.

– Apply clear synthetic-media disclosure where a reasonable viewer could otherwise be materially misled.

– Choose a safer alternative or do not publish when the legality, consent or likely harm remains uncertain.
